1. Overview 

Welcome to Inspire – Learning with Diversity (Inspire), a comprehensive management tool designed to support compliance with the Nationally Consistent Collection of Data (NCCD) and to enhance learning outcomes for students with special needs. Inspire is developed and managed by SRA Information Technology Pty Ltd (ABN 13 055 972 908) (SRA, we, us or our). These Terms of Use govern your access to and use of the Inspire application and this website. By using Inspire, you agree to abide by these Terms of Use.

2. Acceptance of Terms 

When you first log in to Inspire, you will be required to review and accept these Terms of Use before accessing any features or services. By confirming that you have read, understood, and agree to be bound by these Terms, you will be granted access to the application. If you do not agree to these Terms, you will not be permitted to use the application. If any part of these Terms of Use is illegal or unenforceable at law, either in whole or in part, it may be severed and the remaining Terms of Use will continue in full force and effect. We recommend that you read these Terms of Use carefully each time you use the Inspire application or access the Inspire website.

3. Eligibility 

Inspire is intended for use by Teachers, Inclusive Learning Coordinators, Principals, Advisors, Clinicians and Funding Officers at registered schools. By using this service, you confirm that you are authorised to act on behalf of your institution and comply with these terms.

4. Services Provided 

Inspire offers tools and resources to:

  • Support compliance with NCCD evidence collection requirements.

  • Enable educators to implement and monitor tailored learning plans for students with special needs.

  • Streamline the creation and management of funding requests from schools to your head office.

  • Manage requests for service with your school’s Clinicians.

  • Manage and track student data, school information, and staff details.

5. User Responsibilities 

When using Inspire, you agree to:

  • Use the application solely for its intended purpose of managing and supporting improved student learning outcomes and evidence collection for the purpose of NCCD reporting.

  • Ensure the accuracy and completeness of the data you provide.

  • Protect login credentials and prevent unauthorised access to the application.

  • You are responsible for maintaining the security of your username and password. If you suspect that your account has been subject to unauthorised access, you must contact us immediately and take reasonable steps to secure your account, such as changing your password. We are not liable for any claims howsoever arising as a result of the unauthorised use of your password or username.

  • Comply with all applicable laws and regulations, including those relating to privacy and data protection.

6. Access and Use of Inspire

Subject to these Terms of Use, Inspire grants you a limited, non-exclusive, non-transferable, and revocable license to access and use the Inspire application solely for educational and administrative purposes related to your educational institution.

You are fully responsible for any content that you provide to us for display on the website or use in the Inspire application. You agree to use Inspire only for lawful purposes and in accordance with these Terms and our Acceptable Usage Policy.

You agree not to:

Use Inspire in any way that violates any applicable law or regulation.

Use Inspire to transmit any material that is defamatory, abusive, offensive, false or misleading or otherwise objectionable, or any material you have no right to transmit or display.

Attempt to gain unauthorized access to any portion of the Inspire application or any systems or networks connected to Inspire, • use Inspire to develop a competing product or service, reverse engineer, decompile, or disassemble Inspire, or remove any copyright, trademark, or other proprietary notices from Inspire.

7. Data Privacy and Security 

Our Privacy Policy sets out the ways in which we may collect, store, use, disclose and manage your personal information, and explains the physical, electronic and security measures we will take to protect your personal information. By using Inspire, you acknowledge that the stored data is held in Microsoft Azure storage services in the cloud. By supplying us with personal information through Inspire, you accept the inherent security risks of dealing online over the internet and agree not to hold us responsible for any breach of security, unless we have breached a law, been grossly negligent or been in wilful default of our duties to you.

8. Intellectual Property 

All intellectual property rights in Inspire, including but not limited to the application’s design, functionality, and content, are owned by SRA in conjunction with the Catholic Education Office NT. You may not reproduce, modify, distribute, or exploit any part of Inspire without prior written consent from SRA.

Unless expressly stated otherwise, we own or are licensed to use all content appearing on this website (including trade marks, logos, designs and copyright material) (Content). You must not use or reproduce any Content on this website, in whole or in part, except with our express written consent or as permitted under applicable Australian and international laws. If we allow you to use any of our Content, our status as the owner or licensee of that Content must be acknowledged.

We do not own or license, and we take no responsibility for trade marks, logos, design and copyright material appearing in:

  • any third party websites which may be accessible from links displayed on our website; or

  • content that you provide to us.

9. Content We Provide

Unless stated otherwise, we grant to you a personal, non-transferable, revocable and non-exclusive licence to use any files that we expressly state are available for download on the Inspire website or in the Inspire application, for your own use. You must not copy, communicate to the public, modify, reverse engineer, or otherwise transfer any right in those files.

We cannot guarantee that information (including any file) obtained from this website is free from computer viruses, other faults or defects. It is your responsibility to scan the information for computer viruses and you assume the risk of any damage to your computer and associated equipment arising out of the or use of this website or the downloading of any files from it.

10. Links To External Websites

The Inspire website may contain links to websites or advertisements of goods and services available from third parties. We are not responsible for the content of those websites or advertisements, or any goods or services made available on them. Unless expressly stated otherwise, we are in no way endorsing, sponsoring or suggesting an affiliation with that party or their goods or services.

11. Limitation of Liability 

While SRA strives to provide a reliable and effective service, we do not guarantee that Inspire will be free from errors or interruptions. To the maximum extent permitted by law:

  • we are not liable for any damages resulting from the use or inability to use the application;

  • we provide the Inspire website on an “as is” basis. We may suspend access to our website or close it indefinitely without notice and you accept the inherent security and reliability risks of dealings on the internet;

  • we are not liable for loss of revenue, loss of actual or anticipated profits, loss of business or indirect and consequential losses;

  • we are not liable for a breach of our obligations under these Terms of Use which has resulted from causes beyond our reasonable control.

The Teaching Adjustment Strategy recommendations provided by the system are for informational and guidance purposes only. They do not constitute legal, medical, psychological, or educational advice, and should not be relied upon as a substitute for professional judgement. Users remain solely responsible for determining the appropriateness and effectiveness of any adjustment strategies in their specific educational context.

While our system facilitates the collection, storage, and reporting of audit information for government or regulatory purposes, you are solely responsible for the accuracy, completeness, and reliability of any data you enter, upload, or maintain in the system. SRA does not review, or verify data provided by users, and makes no representations or warranties as to its correctness or fitness for any purpose.

12. Termination of Access 

SRA will provide prior notice to users of any intention to suspend or terminate access to the Inspire application. Suspension or termination will occur only where SRA reasonably believes that a breach of these Terms of Use has occurred, or that the user has engaged in unlawful or prohibited activities.

13. Modifications to Terms 

SRA may amend these Terms of Use from time to time to reflect changes in our services, policies, or applicable laws. The most current version of the Terms will always be accessible within the application and on the Inspire website. Following any amendment, you will be required to review and accept the updated Terms before accessing the application. By confirming that you have read, understood, and agree to be bound by the updated Terms, you will be permitted to continue using the application. If you do not agree to the amended Terms, you will not be authorised to access or use the application.

15. Governing Law 

These Terms of Use are governed by and construed in accordance with the laws of South Australia, Australia. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of South Australia, Australia.
